By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately cease using the Site.

01. Acceptance & User Eligibility

By accessing or using the Site, you represent and warrant that:

• You have the legal authority to enter into a binding agreement.
• You will use the Site solely in compliance with these Terms and all applicable local, provincial, and federal laws and real estate regulations.

Note on Brokerage Services: These Terms govern your use of the Site only. Any formal real estate representation, buyer/seller agency agreements, listing agreements, or transactional services offered by Shrine Realty Brokerage Ltd. are governed by separate, executed contracts (e.g., OREA / RECO standardized forms). In the event of a conflict between these Terms and a signed brokerage representation agreement, the signed representation agreement shall prevail.

02. Account Registration & Marketing Communications

To access specific features—such as saved property searches, neighbourhood insights, or automated property alerts—you may be required to register an account.

• Accuracy: You agree to provide accurate, current, and complete information during registration and keep your account details updated.
• Credentials: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• Consent to Communications: By providing your phone number and email address on any form across the Site, you expressly consent to receive communications from Shrine Realty Brokerage Ltd., including email updates, phone calls, and SMS/MMS text messages (which may include automated reminders or transactional alerts).
• Opt-Out: You may opt out of promotional text messages at any time by replying "STOP," or unsubscribe from marketing emails using the link provided at the bottom of the email. Standard message and data rates may apply.

03. Intellectual Property & Permitted Use

All content on the Site—including text, graphics, logos, images, listing data, software, layout, and video (collectively, the "Content")—is the property of Shrine Realty Brokerage Ltd. or its licensors and is protected by Canadian and international copyright, trademark, and intellectual property laws.

Limited License. We grant you a non-exclusive, non-transferable, revocable, limited license to access and view the Site and Content strictly for your personal, non-commercial use in evaluating real estate listings, analyzing market trends, or engaging Shrine Realty Brokerage Ltd. for brokerage services.

Prohibited Conduct. You agree that you will not, directly or indirectly:

• Scrape or Extract Data: Use any robot, spider, scraper, automated tool, or manual process to monitor, mine, or copy listing data, images, or Content from the Site ("screen scraping" or "database scraping").
• Commercial Exploitation: Reproduce, modify, frame, mirror, license, sell, or commercially exploit any portion of the Site or Content without our express written consent.
• AI Model Training: Use any Content or listing data from the Site to train, fine-tune, or feed artificial intelligence or machine learning models without prior written authorization.
• System Interference: Introduce viruses, worms, Trojan horses, or logic bombs, or take any action that overburdens or impairs the operation of our servers and infrastructure.

04. Real Estate Listing & MLS® Data Disclaimers

The property listings and market data displayed on this Site include information provided via the Multiple Listing Service® (MLS®) and CREA's Data Distribution Facility (DDF®) feeds from real estate boards and associations.

1. Informational Purpose Only: Listing content and real estate market evaluations are provided for informational and educational purposes only. They do not constitute formal appraisals, legal advice, tax advice, or financial advice.
2. Accuracy & Currency: While Shrine Realty Brokerage Ltd. strives to keep listing information accurate and up to date, listing data is deemed reliable but not guaranteed. Properties may be withdrawn from the market, sold, or modified without prior notice.
3. Independent Verification: Buyers, sellers, lessors, and lessees are strongly advised to independently verify all property details (including lot size, property taxes, square footage, zoning restrictions, and room measurements) with a qualified real estate representative or legal professional prior to entering into a binding agreement.

The trademarks MLS®, Multiple Listing Service®, REALTOR®, and the associated logos are owned by The Canadian Real Estate Association (CREA) and identify the quality of services provided by real estate professionals who are members of CREA.

05. User-Submitted Content & Interactive Services

If the Site allows you to post reviews, submit property inquiries, upload documents, or interact with chat systems or AI features:

• You retain ownership of any content you submit, but grant Shrine Realty Brokerage Ltd. a worldwide, royalty-free, perpetual license to use, host, reproduce, and process that content as necessary to deliver our services.
• You agree not to upload any content that is unlawful, defamatory, misleading, abusive, or infringes on third-party intellectual property or privacy rights.
• Shrine Realty Brokerage Ltd. reserves the right (but is not obligated) to review, moderate, or remove user content at its sole discretion.

06. Third-Party Links & Services

08. Limitation of Liability

• YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR CONTENT;
• ANY INACCURACIES, OMISSIONS, OR ERRORS IN LISTING DATA OR MARKET STATISTICS;
• ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

09. Indemnification

You agree to defend, indemnify, and hold harmless Shrine Realty Brokerage Ltd., its brokers, sales representatives, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with:

• Your breach of these Terms;
• Your misuse of the Site or Content;
• Your violation of any third-party rights, including privacy or intellectual property rights.

10. Governing Law & Dispute Resolution

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any legal action, suit, or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the courts located in Ontario, Canada, and you hereby consent to the jurisdiction of such courts.

11. Termination

Shrine Realty Brokerage Ltd. reserves the right, in its sole discretion, to terminate or suspend your access to all or part of the Site, without notice or liability, for any reason—including failure to comply with these Terms.
